Hal tersebut semata-mata untuk melindungi seseorang dari tindakan sewenang-wenang penyidik yang kemungkinan besar dapat terjadi ketika seseorang ditetapkan sebagai tersangka, padahal dalam prosesnya ternyata ada kekeliruan maka tidak ada pranata lain selain pranata praperadilan yang dapat memeriksa dan memutusnya.Putusan MK ini memberikan perlindungan terhadap seseorang yang mengalami proses hukum yang keliru pada saat ditetapkan sebagai tersangka.
